Trump administration seeks Supreme Court approval for limited birthright citizenship restrictions


The Trump administration has filed emergency applications with the Supreme Court, asking for restrictions on birthright citizenship to be partly enforced while legal battles continue. The administration’s order, signed by President Trump shortly after starting his second term, seeks to deny citizenship to children born to parents in the country illegally after February 19th. The order is currently blocked nationwide due to rulings by district judges in Maryland, Massachusetts, and Washington.

Despite having their pleas rejected by federal appeals courts, the Justice Department argues that individual judges do not have the authority to extend their rulings nationwide. The administration is now asking the Supreme Court to allow the implementation of the order for everyone except those who have filed lawsuits against it.

The controversy stems from the executive order potentially violating the 14th Amendment of the Constitution, which guarantees citizenship to anyone born on U.S. soil. Five conservative justices on the Supreme Court have previously expressed concerns about nationwide injunctions but have never ruled on the matter.

This is not the first time the administration has faced legal challenges regarding executive orders, notably during the fight over the travel ban targeting Muslim-majority countries. While the Supreme Court ultimately upheld Trump’s policy, the issue of nationwide injunctions was not addressed.

As the legal battle continues, the Trump administration is seeking to move forward with their plan to restrict birthright citizenship, potentially affecting the lives of many individuals and families in the United States.
