CIF’s enforcement of transgender athlete ban under investigation by US Dept of Education


The California Interscholastic Federation (CIF) has stated that it will follow state law which permits trans women and girls to participate in sports consistent with their gender identity, despite President Trump’s executive order banning this practice. The U.S. Department of Education has launched an investigation into CIF for not complying with the executive order, risking the loss of federal funding for schools. CIF’s decision has been described as ‘meaning virtue-signaling’ by the Department of Education, which insists that federal law must be followed in this matter.

Constitutional expert Leslie Jacobs has explained that the executive order revolves around the interpretation of Title IX, which prohibits discrimination in educational institutions that receive federal funds. Trump’s order is based on his interpretation of what constitutes ‘sex discrimination’ under Title IX, particularly with regards to transgender athletes. The NCAA has announced plans to align its policy with the executive order, stating that it provides a clear national standard.

The issue of trans athletes’ participation in sports has sparked controversy and is likely to be challenged in the Supreme Court. CIF has not provided any comment on the investigation by the Department of Education. Meanwhile, the debate surrounding transgender athletes and their rights in sports continues as organizations and government agencies navigate conflicting state laws and federal regulations.
