South Carolina Supreme Court reconsiders abortion issue


With a heartbeat abortion ban currently in effect in South Carolina, lawyers for the state and Planned Parenthood are returning to the state’s highest court to argue over the timing and restrictions of the ban. The law, enforced as a ban on almost all abortions around six weeks after conception, is being challenged by abortion rights groups who argue that the true ban should start around nine or 10 weeks.

The South Carolina Supreme Court is set to hear arguments from both sides, with a decision expected to take several months. The legal fight over the law has been ongoing since 2023, when the state Supreme Court reversed itself after overturning a similar ban in 2021. Since the U.S. Supreme Court overturned Roe v. Wade in 2022, many states have implemented new abortion bans or restrictions.

Currently, 13 states are enforcing bans on abortion at all stages of pregnancy, with limited exceptions. South Carolina and three others have bans kicking in at or about six weeks into pregnancy. The latest lawsuit was filed by a South Carolina resident who had to travel to North Carolina for an abortion due to uncertainties in the law’s language. Some Republicans in South Carolina are also pushing for an outright abortion ban, although no hearings have been held on the matter.
