Federal judge issues temporary injunction on Tennessee’s ‘abortion trafficking’ law


A federal judge in Tennessee has temporarily blocked a law that prohibited adults from assisting minors in obtaining abortions without parental consent. In her ruling, U.S. District Judge Aleta Trauger stated that the state cannot criminalize discussions about abortion options, even in a state where abortion is restricted in most circumstances. The law, which went into effect on July 1, imposed penalties for adults who helped minors get abortions without parental permission, with no exemptions for cases of rape or incest.

The Tennessee law was similar to one enacted in Idaho last year, which has also been temporarily blocked by a federal judge. In response to the Tennessee ruling, Democratic Rep. Aftyn Behn and attorney Rachel Welty filed a lawsuit arguing that the law was unconstitutional and vague. Trauger agreed with their arguments, emphasizing the importance of free speech and the First Amendment.

Tennessee currently bans abortions in all stages of pregnancy, with exceptions for certain medical emergencies. However, the vague wording of the law has raised concerns among medical professionals and advocates. A separate lawsuit is also underway to challenge the state’s abortion ban.

Overall, the temporary block on the law has been praised as a victory for free speech and reproductive rights in Tennessee. The ruling will remain in place as the legal battle continues in court.
